Signed into law on January 8, 2024, the S2760/A4384 supplements the State Uniform Construction Code Act (UCCA). The UCCA regulates the construction, maintenance, modification, and occupancy of New Jersey buildings and structures.
Under the S2760/A4384, a qualified structural engineer NJ must review proposed building plans that create or alter the primary load-bearing system of condominiums or cooperative buildings. The review is now a requirement when applying for a construction permit in New Jersey for new and existing buildings.
The implementation of S2760/A4384 created new responsibilities for property owners. One key requirement is to conduct regular property inspections. These inspections help identify and address any structural issues for occupants’ safety.
The legislation also requires condominium owners and cooperatives to have sufficient reserves for inspections and building maintenance. For compliance, community associations must now be more stringent about their financial planning and building management responsibilities.
